1. Who we are and scope of these terms
This website (derosapro.com) is operated by DeRosa Properties LLC, based in Lowell, Massachusetts (“DeRosa,” “we,” “us,” or “our”).
These Terms of Use govern your access to and use of this website, including (a) browsing rental listings and requesting tours, and (b) submitting property sale inquiries through the “Sell Your Home” section. By accessing or using this site you agree to these terms in full. If you do not agree, do not use this site.
2. Informational purpose only — not legal or financial advice
All content on this site — including property listings, pricing, availability, closing timeline estimates, and any statements about our property-acquisition process — is provided for general informational purposes only. Nothing on this site constitutes legal advice, financial advice, investment advice, or tax advice.
You should consult a licensed real estate attorney, financial advisor, or other qualified professional before making any real estate decision, including any decision to sell property to DeRosa Properties or to rent from us.
3. Rental listings — not an offer to lease
Rental listing details — including availability, rent amounts, amenities, pet and laundry policies, photographs, and move-in dates — are provided for general information, may change at any time, and may occasionally contain inaccuracies. Nothing on this site constitutes an offer to lease, a reservation of a unit, or a promise of availability.
Any tenancy is governed exclusively by a signed written lease agreement executed between DeRosa Properties and the tenant, which controls over anything shown on this website.
4. Property purchase inquiries — no binding offer
Statements on this site regarding property acquisitions — including references to offers, closing timelines, and purchase processes — are general descriptions of our process and are not binding commitments of any kind.
Specifically:
- Any expression of interest in purchasing your property is non-binding until a signed written purchase-and-sale agreement is fully executed by all parties.
- All property acquisitions are subject to DeRosa Properties' independent evaluation, inspection, due diligence, and title review. We do not purchase properties sight-unseen or without our own assessment.
- Closing timelines referenced on this site (e.g., “as few as 5 days”) are estimates based on prior transactions and depend on title clearance, legal requirements, and mutual scheduling. They are not guaranteed.
- “No financing contingency” and similar phrases mean DeRosa Properties does not require a mortgage to close — they do not mean you will receive literal currency. All proceeds are delivered via wire transfer or certified check at closing through a licensed title company or closing attorney.
- Sellers are encouraged to seek independent legal and financial advice before signing any agreement.
5. Form submissions and communication consent
When you submit a tour request, property sale inquiry, waitlist registration, or any other form on this site, you consent to being contacted by DeRosa Properties by phone, text message, or email regarding your inquiry. Standard message and data rates may apply.
Submitting a form does not create any obligation on DeRosa Properties to respond, make an offer, schedule a tour, or enter into any agreement. We respond to all genuine inquiries as promptly as possible but cannot guarantee response times.
We do not sell, rent, or share your personal information with third parties for their marketing purposes. See our Privacy Policy for details on how we handle your data.
6. No warranty of accuracy
We work to keep this site accurate and current, but it is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of accuracy, completeness, merchantability, or fitness for a particular purpose. Verify any detail that matters to you before making decisions — we are happy to confirm specifics when you contact us directly.
7. Intellectual property
The content of this site — text, photographs, graphics, logos, and design — is owned by or licensed to DeRosa Properties LLC and is protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other reproduction, distribution, or use requires our prior written permission.
8. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information through any form on this site;
- Scrape, harvest, or bulk-download site content or data by automated means;
- Interfere with or disrupt the operation of this site or its underlying systems;
- Attempt to bypass or circumvent any security measures on this site;
- Use this site or any information obtained from it for any unlawful purpose;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
9. Third-party links, embedded content, and the automated assistant

We do not control those services and are not responsible for their content, availability, accuracy, or privacy practices — including where a third-party service is compromised, defaced, or misused by others. The chat feature on this site is an automated, pre-scripted assistant — not a human agent and not artificial intelligence. Its responses are general information provided as a courtesy for tenant convenience only; they may be incomplete, outdated, or incorrect, and do not constitute legal, financial, or professional advice, nor a promise, amendment, or waiver of any lease term. Always verify time-sensitive or official matters (including city parking rules, utility procedures, and emergency guidance) through the relevant official channels, and direct binding requests to our office or your tenant portal. 10. Equal Housing Opportunity

We comply with the federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and Massachusetts fair housing law (G.L. c. 151B), and we do not discriminate on the basis of race, color, national origin, religion, sex, familial status, disability, ancestry, age, sexual orientation, gender identity, veteran or military status, genetic information, or any other characteristic protected under applicable federal or state law, including source of income.
11. Limitation of liability
To the fullest extent permitted by applicable law, DeRosa Properties LLC, its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to (a) your use of, or inability to use, this site; (b) any reliance on information contained on this site; (c) any transaction or potential transaction involving the sale or rental of property; or (d) any unauthorized access to or alteration of your communications or data.
Our total aggregate liability to you for any direct damages shall not exceed one hundred U.S. dollars ($100.00). Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or willful misconduct.
12. Indemnification
You agree to indemnify, defend, and hold harmless DeRosa Properties LLC and its members, managers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of this site, (b) your violation of these Terms of Use, (c) any false or misleading information you submit through this site, or (d) your violation of any applicable law or third-party right.
13. Entire agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and DeRosa Properties LLC with respect to your use of this website and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the same subject matter. Any signed lease agreement or signed purchase-and-sale agreement between you and DeRosa Properties governs the specific transaction it covers and is separate from these Terms.
14. Changes to these terms
We may update these Terms of Use at any time. The “Effective date” above reflects the latest revision. Your continued use of this site after a change is posted constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
15. Governing law, jurisdiction, and contact
These Terms of Use are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Middlesex County, Massachusetts for any dispute arising under or related to these terms.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
